1. Acceptance of Terms
By accessing or using TrainerBio (trainerbio.com), operated from the United Kingdom, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Description of Service
TrainerBio provides fitness professionals (“Trainers”) with tools to create professional landing pages, sell digital products, manage client enquiries, and accept payments. Visitors and buyers (“Customers”) can view trainer profiles, submit enquiries, and purchase digital products.
3. Accounts
- You must be at least 16 years old to create an account
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- One person may not maintain more than one account without our permission
- You are responsible for all activity that occurs under your account
4. Free and Pro Plans
TrainerBio offers two tiers:
- Free plan: Includes full profile customisation, up to 3 featured links, and a digital product store. A 15% platform fee applies to digital product sales.
- Pro plan (£4.99/month): Includes all Free features plus unlimited featured links, custom enquiry forms, engagement tools (announcements, countdowns, action buttons), advanced themes, and 0% platform fees on sales.
Pro subscriptions are billed monthly via Stripe. You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period — you retain Pro features until then. Refunds are handled on a case-by-case basis.
5. Payments and Stripe Connect
To sell digital products and receive payouts, Trainers must connect a Stripe account via Stripe Connect Express. By doing so, you also agree to Stripe’s Connected Account Agreement.
- Payments from Customers go to the Trainer’s connected Stripe account, minus any applicable platform fee and Stripe processing fees
- Free plan Trainers pay a 15% platform fee on each sale; Pro Trainers pay 0%
- Stripe’s standard processing fees apply to all transactions regardless of plan
- Refunds and disputes are handled between the Trainer and Customer. TrainerBio is not a party to transactions between Trainers and Customers
6. Digital Products
- Trainers are solely responsible for the content, quality, and legality of their digital products
- Digital products must not contain malware, illegal content, or content that infringes third-party intellectual property rights
- Buyers receive time-limited, download-limited access to purchased files. TrainerBio does not guarantee indefinite access to purchased products
- TrainerBio acts as a platform facilitating the sale and is not the seller of digital products
7. Third-Party Integrations
TrainerBio integrates with third-party services including Stripe and Google. When you connect a third-party account:
- You authorise TrainerBio to access the specific data required for the integration
- You can disconnect any integration at any time from your dashboard
- Third-party services are governed by their own terms and privacy policies
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Infringe on the intellectual property rights of others
- Upload or distribute harmful, offensive, or misleading content
- Impersonate another person or entity
- Attempt to gain unauthorised access to other accounts or systems
- Sell fraudulent, misleading, or plagiarised digital products
- Use the platform to send spam or unsolicited communications
- Sell products that promote dangerous or illegal activities
- Interfere with or disrupt the Service or its infrastructure
We reserve the right to suspend or terminate accounts that violate these terms.
9. Intellectual Property
- Your content: You retain ownership of all content you upload to TrainerBio (profile information, digital products, images). By uploading content, you grant us a limited licence to host, display, and distribute it as necessary to operate the Service.
- Our platform: The TrainerBio platform, brand, design, and code are our intellectual property. You may not copy, modify, or redistribute any part of the platform.
10. Trainer Responsibilities
As a Trainer using TrainerBio, you are responsible for:
- Ensuring your digital products comply with all applicable laws, including consumer protection regulations
- Handling customer service, refunds, and disputes for your products
- Complying with UK GDPR and data protection laws when collecting personal data through enquiry forms
- Accurately describing your products and services
- Declaring any income earned through TrainerBio for tax purposes
11. Limitation of Liability
TrainerBio is provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform
- We are not liable for any loss of revenue, data, or business opportunities
- Our total liability for any claim related to the Service is limited to the amount you have paid us in the 12 months preceding the claim
- We are not responsible for the content, quality, or legality of Trainer products or the conduct of any user
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Availability
We strive to keep TrainerBio available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We are not liable for any losses caused by temporary unavailability of the platform.
13. Termination
- You may delete your account at any time. Active Pro subscriptions will not be refunded for the remaining billing period.
- We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
- Upon termination, your right to use the platform ceases. We may delete your data in accordance with our Privacy Policy.
14. Changes to Terms
We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of TrainerBio after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
